What are the three types of B&E?

Section 348 (1) of criminal code:
Everyone who,
(a) breaks and enters a place with intent to commit an indictable offence therein,
(b) breaks and enters a place and commits an indictable offence OR
(c) Breaks out of a place after:
(i) committing an indictable offence
(entering the place with the intent to commit an indictable offence therein,
Punishments if convicted of B&E: in a dwelling house
of an indictable offence if committed in relation to a DWELLING HOUSE
maximum penalty: life
Penalty if B&E committed in place other than a dwelling house:
Term not exceeding 10 years
or
Summary conviction
Definition of BREAK:
(a) to break any part, internal or external OR
(b) to open anything tha is used to close or to cover an internal or external opening
Definition of ENTER:
a) a person enters as soon as any part of his body or any part of an instrument that he uses is within anything that is being entered
b) a person shall be deemed to have broken and entered if
- he obtained entrance by a threat or artifice or by collusion with a person within, or
- he entered w/o lawful justification or excuse, the proof of which lies upon him, by permanent or temporary opening
Define PLACE
a. a dwelling house
b. a building or structure or any part thereof, other than dwelling house
c. a railway vehicle, vessel, aircraft or trailer, or
d. a pen or enclosed in which fur bearing animals are kept in captivity for breeding or commercial purposes
Defien Dwelling house:
dwelling-house means the whole or any part of a building or structure that is kept or occupied as a permanent or temporary residence, and includes
(a) a building within the curtilage of a dwelling-house that is connected to it by a doorway or by a covered and enclosed passage-way, and
(b) a unit that is designed to be mobile and to be used as a permanent or temporary residence and that is being used as such a residence;
Define Curtilage:
a piece of ground (as a yard or courtyard) within the property surrounding the house

Section 348(2) (a)
broke and entered a place or (attempted) is in the absence of any evidence to the contrary, proof that he broke and entered the place or attempted to do so, with the intent to commit an indictable offence therein,
Section 348(2)(b)
broke out of a place is, in the absence of any evidence to the contrary, proof that he broke out after
(i) committing an indictable offence therein, or
(ii) entering with intent to commit an indictable offence therein

Unlawfully in a dwelling house -Section 349:
(1) Everyone who, without lawful excuse, the proof of which lies on that person, enters or is in a dwelling house with intent to commit an indictable offence in it, is guilty of an indictable offence (10 years or Summary conviction)
Possess Break in Instruments- Section 351:
Although Motor is not a “Place” for a charge of break and enter, possession of an intrument suitable for breaking into motor vehicle is a charge under the CC
