What is the purpose of the “grievance system”?
To provide a confidential process for solving problems/complaints.
What is a grievance?
Any claim by an employee who’s rights/benefits/privileges have been violated.
What issues are NOT subject to a Grievance Process?
- Any matter where City is without authority to act
- disciplinary action of an employee
- performance evaluation
- classification system or pay plan
- certain actions within the managerial discretion of a dept head
What 4 things must a “statement of grievance” contain?
It must specify:
- the facts/conduct about the grievance
- details about the violated policy
- requested remedy
- a statement from the employee to start the grievance with
What must an employee do PRIOR to initiating a written grievance?
An employee must discuss his complaint with his immediate supervisor (if problem is not resolved verbally, employee can put grievance in writing).
How long, after a problem is identified, does the employee have to verbally present it to the supervisor?
The employee has 10 days from the date of the problem, to verbally present to supervisor (supervisor/employee have 5 days to find informal resolution).
Some situations, concerning filing a grievance, require a time extension. Who can approve these extensions?
Extensions must be approved by HR/RM Director.
What happens when an employee fails to file a grievance within the established time limit?
The employees grievance rights are forfeited.
What 5 members make up the Grievance Committee?
5 voting members, randomly selected by City Mgr. from first line clerical, first line field, professional level, mid manager level, and supervisory level.
If it is found that a Grievance committee member is not performing their duties, what can happen to that employee?
The City Mgr may terminate the members term.
How can a member of the grievance committee voluntarily disqualify themselves in a given case?
They can voluntarily remove themselves for ANY reason.
What department is exempt from participating in the grievance committee?
HR/RM Dept staff are not eligible.
