What is an EPC?
A
- An Energy Performance Certificate, which is used to report on the properties energy efficiency
- Valid for 10 years

When should you instruct an EPC?
A
- An EPC is legally required if the property is to be let or sold
- If the unit/property is over 1000m2 then an action plan is also required under section 63

A
- Property name and address
- Size of unit
- EPC register reference number
- Date of assessment
- Energy rating

What buildings require an EPC?
A
All commercial and residential properties

Which buildings are exempt from having an EPC?
A
- stand-alone buildings (other than dwellings) with a useful floor area of less than 50m²
- temporary buildings with a planned use of two years or less
- buildings with a low energy demand, i.e. non-residential agricultural buildings and workshops
- buildings sold for the purpose of demolition

How would you find a completed EPC?
A
- Request from the company who carried out the assessment
- Check on the Scottish EPC Register website –

When are the penalties for not having an EPC?
A
- £1,000 penalty charge notice for non-residential structures.
- Additionally, local authorities (enforcement authorities) may contemplate criminal action.

What is an action plan and when is it applicable?
A
- The action plan notes any changes to the property that must be carried out within a set time frame.
- Applicable if the unit is over 10,000m2 then an action plan is required.
- If an action plan has been carried out and the property is sold, the new owners are still legally required to action any of the changes.
