Should you let a person or their carer know that you are raising a concern about them?
Ideally, yes, but not being able to should not stop you raising the concern.
Do you need a person’s permission to raise a safeguarding concern for them?
No. But…
It is essential to consider whether the adult at risk is capable of giving
consent for a referral to be made. If they are, consent should always be sought. If, however, the adult at risk has mental capacity and refuses to consent to a referral, their wishes should be
respected unless:
• There is a public interest i.e. not acting will put others at risk.
• Their vital interest is compromised – i.e. there is a (immediate) risk of death or major harm.
• There is a duty of care i.e. a crime has been or may be committed.

What is the difference between a safeguarding concern and a serious outstanding risk?
Welfare issue (serious outstanding risk) is the term used to refer to concerns which do not strictly sit under adult safeguarding processes, because ‘abuse’ as defined in the Care Act has not happened and/or the person does not meet the criteria listed in the Act.
In essence, there are 3 kinds of brigade response to safeguarding concerns. What are they?
Immediate risk: call police, LAS as appropriate. If safe, two crew members stay with the individual.
Safeguarding concern - Immediate risk: refer within 4 hours
Welfare issue (serious outstanding risk) - refer within 24 hours.
Who has responsibility for deciding whether to refer the matter to the safeguarding adults team within the local Social Services Department (SSD)?
The BC/duty DAC.
