Q.C.C.F.S
What does Q.C.C.F.S. Stand for?
Q = Questioning C = Cautioning C = Cross Examination F = Fair Explanation S = Statement Recording
Practice Note - One
Note 1: Questioning
A police officer can question anybody; however the person cannot be compelled to answer.
Practice Note - Two
Note 2: Cautioning
When police have sufficient evidence to charge or when questioning a person in custody - the person must be cautioned of their RIGHTS before being invited to make any statement or answer any questions.
Practice Note - Three
Note 3: Cross Examination
Questions being asked of a person in custody cannot amount to cross-examination.
Practice Note - Four
Note 4: Fair Explanation
When questioned about statements made by others or about other evidence. The substance or nature of the evidence must be FAIRLY explained, i.e.
“The description of the suspect given by the person at the scene ….”
Practice Note - Five
Note 5: Statement Recording
Statements of a person in custody should preferably be recorded on DVD/Video.
Written statements should always be signed by the person giving them.
Include the wording “I have read this statement and it is true and correct”
What may happen if you breaching the Practice Note or Bill of Rights?
Breaching the Practice Note or Bill of Rights may result in:
The evidence may be disallowed.
The case may be dismissed.
An officer’s credibility could be doubted.
Could result in adverse publicity, legal criticism, or formal complaints.
Internal Police enquiry.
Possible criminal charge.
