The Occupational Health and Safety Act (RSO 1990), in Part III (Duties of Employers and Other
Persons) under Section 27 (1) (a) (b) states – “Duties of supervisor” (pg. 29), a supervisor shall
ensure that a worker,
A. Knows his/her right to participate, and right to stop work.
B. Works in a manner and with the protective devices, measures and procedures required by this Act
and the regulations; and uses or wears the equipment, protective devices or clothing that the
worker’s employer requires to be used or worn.
C. Knows his or her right to be ensured that protective devices are cleaned regularly.
D. Is to be provided with materials and protective devices as prescribed.

The Occupational Health and Safety Act (RSO 1990), in
Part III (Duties of Employers and OtherPersons) under Section 28 (1)(c) – “Duties of workers”
(pg. 29) (c) states a worker shall:
A. Bring their own device(s) to the workplace.
B. Not be responsible to ensure that the equipment, materials and protective device(s) provided by
the employer are used as prescribed.

The Occupational Health and Safety Act (RSO 1990) in Part III.0.1 (Violence and Harassment)
under Section 32.0.1 (1) “Policies, violence and harassment” states an employer shall;

A Guide to the Occupational Health and Safety Act, (2015) Part III, Section 25 (2)(c) Duties of
Employers states that an Ontario Employer who is covered by the Act, has an obligation to
appoint competent persons as supervisors. “Competent person” has a very specificmeaning
under the Act. He or She must:
