Tell me about your experience of a legal/regulatory requirement relating to a project.
I was involved in the PM of a conversion to a HMO this required making the property compliant e.g., room sizes, fires safety, smoke alarms etc.
Tell me about a current piece of case law you are aware of relating to your role.
Warren and Keen Ð Tenant like manner. Tenants have to undertake task as part of their occupancy e.g., mowing the lawn etc.
Tell me about a current planning policy issue you are aware of.
NPFF planning for climate change e.g., reducing greenhouse gases.
Tell me about your understanding of the law relating to conservation areas/listed buildings/planning policy/S106 agreements/CIL?
Listed buildings and conservation areas are protected by the Planning (Listed Building and Conservation Areas) Act 1990Õs.
Town and Country Planning Act 1990 Ð Planning (right to grant planning permission through public bodies).
Section 106 Ð Legal agreement between applicant and LPA covered by the Town and Country Planning Act 1990.
CIL Ð levy charge for local authorities on new development - The planning Act 2008
What is a listed building?
Buildings considered to be of special architectural or historical interest. There are 3 grades
What is a conservation area?
Areas of special architectural or historical interest, the character of which is desirable to preserve or enhance.
Tell me about an example of where you have applied health & safety at work practices/disability/construction design and management regulations.
When undertaking inspections I adhere to company policy and surveying safely which is underpinned by the HSAWA 1974.
West View Place: When advising the client to seek an indemnity policy did you give any other advice about how to proceed with this?
I advised the client to seek legal advice for the indemnity policy
West View Place: If the works were done 20+ years ago, are they outside any time limit for enforcement action?
No there is no four year provision in listed building law.
West View Place: Could the local planning authority require the longstanding noncompliance to be rectified as part of any subsequent application for consent to undertake other non related work to the building?
Yes, If a planning officer came to visit they could provide and enforcement notice.
Newton Street: What was the age of the house? How old were the spindles? Did you recommend changing the spindles? Why is the 100mm gap specified in the Building Regulations?
1950Õs and original, Yes as the client had a small child. The 100mm gap specified in the building is to prevent small children causing harm to themselves when sing the stairs.
You are inspection a Victorian property on three floors. The third floor is an original loft room approached via a fairly steep staircase. How do you advise the client?
The staircase is not complaint with modern day regulations and this is a risk factor
