When a health practitioner is convicted of any offense carrying a possible penalty of imprisonment for 3 months or longer, the pharmacy council must notify the professional conduct committee
The HPDT may discipline if it finds 1 or more of the following: (x6)
- Professional misconduct
- Conviction of an offence that reflects adversely on their fitness to practise as a health practitioner
- Practising without a current certificate
- Performed a health service outside their scope of practice
- Failure to observe conditions in RHP’s scope of practise
- Breach of a tribunal order
What is meant by professional misconduct? x2
- Any act or omission that amounts to malpractice or negligence
- Any act or omission that has brought/was likely to bring discredit to the profession
Define malpractice and define negligence
Malpractice: unethical conduct
Negligence: providing care below the standards required
Possible sanctions from HPDT x5
- Censure (official telling off)

In what cases would you be able to notify the pharmacy council about a healthcare practitioner?
- HCP may pose a risk of harm by practicing below required standard of competence
- HCP is unable to perform required functions due to a mental or physical illness
When MAY you give written notice to the pharmacy council, and when MUST you give written notice to the pharmacy council?
May give: if you think a practitioner may pose a risk of harm by practicing below required competence standards
Must give: if you think a practitioner is unable to perform their required functions due to a mental or physical condition.
