What is a juvenile?
Any person under 18
Behavior is governed by impulse rather than rational thinking. The brain is still maturing and developing well into the mid 20s.
What age range defines a delinquent child?
12-18 years old
Children under 12 lack the mental capacity to form criminal intent.
What is delinquency?
Acts that if performed by an adult would be termed criminal.
Who can initiate a Care and Protection Order?
ANYONE
This order is to remove children from abusive and unsafe environments.
What are the locations to take a juvenile?
- Medical facility
- Residence
- Police Station
Must have I# to complete a missing persons form.
What age range defines a youthful offender?
14-18 years old
Applies to juveniles who committed a felony and have previous DYS Commitment or committed certain firearm offenses or offenses involving serious bodily harm.
Who are mandated reporters?
Persons in their profession who have reasonable cause to believe a child is suffering physical or emotional injury resulting from abuse or neglect.
Examples: Police officers, nurses, teachers, doctors, EMTs, firefighters.
What is the first step of a 51A report?
Orally notify DCF
A written report must be filed within 48 hours.
What is protective custody?
Taking a juvenile (intoxicated) without their permission.
Juveniles have the right to a phone call and must be kept separate from adults in custody (sight and sound).
How long can you hold a youthful offender?
6 hours.
