What is Flag State?
A flag state is the country under whos laws a vessels is registered to. It ensures compliance with international conventions and national laws. They conduct inspections, issue certificates, and on occasions where necessary take enforcement actions.
What are the responsibilities of the Flag State?
- Maintaining a registry
- Ensuring ships are seaworthy
- Enforcing regulations
- Investigating violations
What is Port State Control?
A port state is the inspection of foreign ships in national ports to ensure compliance with international maritime conventions and regulations. They verify the condition of the ship, equipment, and crew as a second line of defense against substandard shipping.
What are the consequences of deficiencies found during port state inspections/.
- Defects can be required to be put right immediately or within a set time frame
- For serious deficiencies the ship can be detained
What are Memoranda of Understanding (MoUs)?
- They establish cooperation and coordination between port states to ensure effective port state control
- Standardizes inspections procedures
- Information sharing about non-compliant ships
- Helps to protect port states from substandard ships
