Assault
- intentionally threaten violence, by word or act,
- appeared to have the ability to carry out the threat
- created in the mind of the victim that violence was about to take place.
Aggravated Assault
all the elements of assault plus, made the assault with a deadly weapon without intent to kill, or with an intent to commit a felony. Aggravated assault is a felony of the third degree.
Battery
- intentionally touched or struck the victim
- intentionally caused bodily harm to the victim.
Aggravated battery
- intentionally caused great bodily harm
- used a deadly weapon.
Felony battery
Battery that caused significant injury, great bodily harm, permanent disability, or permanent disfigurement to the victim.
Domestic battery by strangulation
a felony battery that is against a family or household member or someone with whom the victim is in a dating relationship. Intentionally impedes the victim’s breathing or circulation against their will by applying pressure on the throat or neck, or by blocking the victim’s nose or mouth.
RECLASSIFICATION
This can occur when the victim is 65 or older or is:
* School employee
* A sports official
* An emergency medical care provider
* A firefighter or Police Explorer
* A public transit employee
* A criminal justice officer
* a traffic accident investigation officer, traffic infraction enforcement officer, or parking enforcement specialist
* a College security officer
WARRANTLESS ARREST
when the assault occurs:
* in your presence,
* during a domestic violence situation, or
* upon a LEO, firefighter, EMT , public transit employee
