Initial Appearance
PRIMERA COMPARECENCIA
All defendants appearing for the first time in this court are advised that you have the right to remain silent. You are not obliged to make any statement here in court, but if you do make a statement the content of that statement may be used against you in future proceedings.
A todos los acusados que comparecen por primera vez en este juzgado se les informa que tienen el derecho a permanecer callados. No están obligados a presentar ninguna declaración aquí en el juzgado pero si hacen una declaración, el contenido de la misma puede ser usado en su contra en diligencias futuras.
You have the right to an attorney and the right to have that attorney present with you during all court proceedings.
Tienen el derecho a tener un abogado y el derecho a que ese abogado esté presente con ustedes durante todas las diligencias judiciales.
You also have the right to have that attorney present with you anytime that you are questioned by an agent of the government.
También tienen el derecho a que ese abogado esté presente con ustedes en cualquier momento que sean interrogados por un agente del gobierno.
If you do not have the money to hire your own attorney, this Court will appoint an attorney for you after you have shown that you do not have the funds to hire your own attorney. In order to show that you do not have the money to hire your own attorney, I will require that you fill out a financial affidavit. That financial affidavit is made under penalty of perjury. If you make any false statements in the financial affidavit, you could subject yourself to further prosecution.
Si no tienen el dinero para contratar a su propio abogado, este juez le nombrará uno después que ustedes hayan comprobado que no tiene los medios económicos para contratar a su propio abogado. You are here for an initial appearance before the United States Magistrate. The purpose of this appearance is for you to be told what the charges are against you and to have the Court set conditions for your pretrial release. You have the right to a preliminary hearing to determine if there is probable cause to believe that you committed the crime which is alleged against you in the complaint. That hearing must be within ten days of today’s date should you be in custody, or within twenty days of today’s date if you are not in custody.
Están aquí para una comparecencia inicial ante el Juez Federal. El propósito de esta comparecencia es que les digan cuales son las acusaciones en su contra y para que el juez fije las condiciones para la libertad previa al juicio. Tienen el derecho a una audiencia preliminar para determinar si hay motivo fundado para creer que cometieron el delito que se presume en su contra en la acusación formal. If at anytime before the end of the ten or twenty day period of time you are indicted by the federal grand jury, then you no longer would have the right to a preliminary hearing.

You also have the right to be released on reasonable bail. If you cannot make the bail which the Court sets for you here today in this hearing, you have the right to come back to this court at some later time to have the Court again consider whether the bail that was set in your case was the proper bail for your case after considering the facts and circumstances of your case and your particular, individual situation.
También tienen el derecho a ser puesto en libertad bajo una caución razonable.
