A patent is a licence that provides
a business with exclusive rights to
use innovative devices, substances,
methods and processes.
What is this an example of?
Biggie Smalls Kbabs is a Melbourne based hip
hop diner and food truck owned by celebrity chef
Shane Delia. Cotton On released a new range
of caps and socks which featured Biggie Smalls
Kbabs’ logo. Biggie Smalls Kbabs sued Cotton
On for infringing the copyright of its logo and
business name. The case was heard in court
where Shane Delia claimed significant business
losses, particularly in relation to the damage
caused to Biggie Smalls Kbabs’ reputation as a
result of the copyright infringement. Cotton On
removed the items from sale and the copyright
claim against Cotton On has now been settled.
