To qualify in New York State, children under 3 must have a confirmed disability or demonstrate delay in one or more of the following areas:

Early Intervention Program (EIP) regulations for eligibility criteria for developmental delay:

3 main definitions of what it means to have a developmental delay and to qualify for services
The child must be experiencing a 12 month delay in one or more functional areas, or
A 33% delay in one functional area or a 25% in each of two areas; or,
If standardized assessments are used, a score of at least 2 standard deviations below the mean in one functional area or a score of at least 1.5 standard deviations below the mean in two functional areas.

The IFSP is created by the multidisciplinary evaluation team, along with the parent.
What must the IFSP include?
A statement of the infant or toddler’s current level of development based on objective criteria, in the five areas assessed for eligibility.
A statement regarding the family’s resources, priorities or concerns.
Statement of measurable outcomes
Statement of the natural environments which services will take place
Projected dates for services to begin and anticipated length, duration and frequency of services
2x/week for 30-59 minutes (basic visit)
Identification of the service coordinator
Steps to support transition to preschool or other services
IDEA Part B
Under part B states and public agencies must provide a free and appropriate public education (FAPE) in their least restrictive environment (LRE).
