What is the Human Rights Act 1998 (HRA)?

A

It sets out fundamental rights and freedoms that everyone is entitled to.

It incorporates the rights set out in the European Convention on Human Rights into domestic British Laws.

It came into force properly into the UK in October 2000.

What is the Right to Life?

A

Services provide care to preserve life.

Individual practitioners cannot make the decision to turn off life support.

E.G hospitals should provide medication and treatments designed to preserve life.

What is the Right to Respect, Privacy and Family Life?

A

We should maintain and respect individual’s privacy, help people live as independently as they can and have a family life.

E.G do not discuss a resident’s care options where it can be overheard.

What is the Right to Liberty and Security?

A

An individual cannot be detained or deprived of their freedom unless they have committed a serious crime or assessed under the Mental Health Act.

E.G someone has been assessed as being a danger to themselves due to schizophrenia.

A

Individuals should have the opportunity to express their own opinions.

E.G patients should be given a choice in their treatment and consulted about their wishes and options.

A

Individuals should not be discriminated against based on their views, wishes, beliefs and interests.

E.G we shouldn’t isolate a child because they celebrate a different festival.
