Explain section 131 of the Search and Surveillance act
Section 131 is my notification obligations relating to searching a Property or Vehicle.
It includes using RAIN
What powers does Section 14 Search and Surveillance act give me:
- I can enter a property if I have RGTS an offence is about to occur than can cause serious harm to a person or damage to property
- There is risk to the life of safety of a person that requires emergency response
This is and ENTREY power not a search power
What does 169 demand that I do after a warrantless search?
Law: I need to report it as soon as reasonably possible
Police standards: I need to report it by the end of my shift
This apples to sections 7,8,29,83,84
When searching for a person what power does section 7 give me?!
Search power for somebody
- Unlawfully at large
- Escaped from custody
What power does section 8 SAS Act give me:
Power to enter a building for arrest if I have RGTS that a person has committed an offence and RGTB that they are in that building
AND
I Suspect that they’ll avoid arrest if I don’t enter
OR
CADD Will occur if I don’t enter
What section gives me power to enter a building to search for somebody who has escaped custody or has a warrant for arrest?!

What do sections 83 and 84 of the Search and Surveillance act give me powers to do Post-Arrest:
Section 83 - Power to enter a place to search for evidential material relating to arrest IF CADD can occur
Section 84 - Power to search a vehicle
What are some practical powers in Section 110 in the Search and Surveillance act
This act gives me powers of Force for the PURPOSE of carrying out a search/seizure. It’s in incidental
I.e I’ve entered a building, I need to break a lock to go into a room
It also allows me to use any item in the property to carry this out
What section gives me power to take illegal items in ‘Plain view’ during a search
