Define “Mental disorder”?
Person who have an abnormal state of mind. This can be seen in: Delusions, Disorders of moods, perception, volition etc to such a degree:
- That they pose danger to themselves or others
- Or that they diminish the capacity of that person to take care of themselves
Define Special patient
Detained by court order. Criminally insane or unfit to plead
Define restricted patients
Subject to CTO and are a present danger to public
Explain section 109 of the Mental health act:
Somebody who are mentally disordered in a public place can be detained and must be taken to be assessed.
Detain for 6 hours
Explain Section 41 of the Mental Health act
Somebody who are mentally disordered in a private place can be detained and must be taken to be assessed.
Police can enter with force but ONLY with a DAO present.
Detain for 6 hours and take to a place that the DAO desires
Explain Section 110 times of the Mental Health Act 1992
Police can, under request of a medical practitioner, use powers of entry/force to detain a patient for the purposes of assessment
- Sedation can be used
What are powers surrounding returning special patients and Mental patients
If they have absconded I can apprehend and return to hospital at ANY TIME
What are powers surrounding returning an in patient subject to a Compulsory treatment order to a hospital
These patients who have been absent without leave or fail to comply with the order can be apprehended and returned to hospital within 3 months of going missing
What is the timeframe of detention for mental health assessments
6 hours
Who can apply for a person to undergo a compulsory mental health assessment
Anyone 18+. Normally a family or a doctor
Not appropriate for police to apply for these
