  • What is legislation?
  • Name and define the 4 acts that need to be followed by organisations
A
  • Rules determined by the government, setting out procedures people must follow. There are consequences if these are not followed.
  1. HASAWA - Health and Safety at Work Act
    * Outlines responsibilities of employer and employee to ensure a safe working environment
  2. National Minimum Wage Act
    * Sets out minimum amount of pay workers are entitled to per hour (based on a workers age)
  3. The National Living Wage
    * Higher than the National Minimum Wage - only for workers above 23
  4. Equality Act
    * Designed to ensure all employees are treated fairly in the workplace and prevent discrimination.

Responsibilities of employers
* Provide and maintain a suitable working environment
* Provide staff with training and safety info
* Prove staff with protective clothing/equipment if needed

Responsibilities of employees
* Take reasonable care for their own safer and others
* Cooperate with employers on health and safety matters
* Do not misuse, tamper or interfere with equipment

Give the 4 features of the Equality Act

A
  1. Organisation cannot discriminate against employees (for recruitment, selection, training, promotions, etc.)
  2. Protects individuals that have protected characteristics
  3. Harassment - employees can complain of behaviour they find offensive → Even if not targeted at them
  4. Victimisation – employees are protected if treated badly because they have made/supported a complaint under the Act

A

Direct: Person discriminates against another because of one of these protected characteristics
Indirect: Person puts conditions in place that put another at a disadvantage because of one of the protected characteristics.

Give 5 consequences of Legislation

A
  • Extra money needed to install ramps and other equipment
  • Increasing employee’s wages if the minimum wage or living wage is increasing
  • Fine if the organisation breaks the law
  • Name and Shamed for not following National Minimum Wage Regulation
  • Bad publicity for the business
    Resulting in a customer boycott
    Fall in sales and profits
