How can SPCs be applied for

A

apply for certificate within 6 months of receiving valid authorisation to put it on the market, if the product is protected by a patent in force. (or within 6 months of grant if it is later). Pay the application fee and a cumulative renewal fee in advance for the whole duration (same 6M grace period as patents)

What is the duration of an SPC

A

Maximum term is 5 years (with 6m extension in some circumstances)

Term is lesser of five years and the period between the date of “lodging” the patent application and the date of product authorisation, minus five years
