The Enhanced Cooperation Mechanism: what is it and how is it useful?
(Art. 20 TEU + 326 TFEU)
Is a last resort introduced by the Treaty of Amsterdam when it’s almost impossible for MS to act jointly altogether. It helps fastening the integration process with a minimum of 9 members.
What competences can be object of the ENHANCED COOPERATION MECHANISM
Only the non-exclusive competences (Shared)
Who authorizes the ENHANCED COOPERATION MECHANISM?
The Council, with an ad hoc decision after obtaining consensus by EP and on a proposal of the Commission.
It enjoys a margin of discretion for prerequisites and participating conditions.
It must decide that the objective is not achievable in other ways.
