What part of the Treaties governs CFSP?
Title V TEU
What makes CFSP special?
1) Discipline is separate from other areas of Union competence
2) In this field, a less prominent role is reserved to ECJ, EP and COMMISSION
What institutions lead CFSP & CSDP decision-making? How?
1- European Council: composed of head of govs, establishes UNANIMOUSLY strategic guidelines and objectives
2- Council of the EU: composed of ms ministers, develops the foreign policy and common positions on geographical issues basing on EUROPEAN COUNCIL
How does the Council of the eu votes on CFSP?
1) Reasoned abstention is rare but possible and the abstained state is not obliged to adopt the decision
2)EMERGENCY BRAKE in case of votings that require qualified majority (balancing each other): POWER NOT TO ADOPT A DECISION FOR VITAL AND STATE REASONS OF NATIONAL POLICY
Whats the role of the High Representative for CFSP/CSDP? (HR)
- Shares with the council the task to ensure unity, coherence and effectiveness of common actions
- Uses national and common resources to implement CFSP acts
- Has the duty to consult and respect Parliament’s opinion
The role of Court of Justice in the area of CFSP
The Court is generally powerless, except for two situations:
a) adjudication on disputes concerning boundaries between Union competences and CFSP
b) legality of decisions providing restrictive measures towards legal and natural persons
General Consistency principle in CFSP
General Consistency principle guides CFSP and other external union policies to be coherent in their application
Mutual Solidarity principle in CFSP
CFSP actions should be based on mutual solidarity among MS
This is also the base for the CLAUSE OF ASSISTANCE, for the MS are obliged to support and aid the Ms that is object of armed aggression or terrorist attack, bY ALL MEANS IN THEIR POWER

The Common Security and Defence Policy is a part of CFSP that includes the PROGRESSIVE DEFINITION OF A POLICY AIMING AT THE ESTABLISHMENT OF A COMMON DEFENCE SYSTEM
Includes possibility to carry out joint tasks outside Union’s territory

MS are expected to coordinate their respective positions in International conferences
MS that enjoy a Permanent Seat at the UNSC should allow the HR to present in the SC the Common Position adopted by the EU
When do EU Sanctions are activated?
Are decided in accordance with art.29 TEU when implementing a UNSC resolution

Are decided on the Union’s initiative
In what measures do EU Sanctions consist?
Capital freezing, Payment block, Entry denial
