1. is there a TOW incorpertaing principle
A provision incorporating the Treaty of Waitangi (ToW) will legally limit what a decision-maker can do. If ToW principles aren’t mentioned in the law, the principle of legality (as used in Trans-Tasman cases) means courts will interpret laws in line with Treaty principles, unless it’s clearly impossible to do so.
whats under the second step of how strongly is a provision worded
a strong provision can reuqire a stronger DOC from the crown (tamaki)
- weak provison only imparts negative duties (LANDS CASE)
- an elaborative provison will not be interpreted as being exahuastive unless is is clear parl inteneded it to be exhaustive (tt)
