Are mail order pharmacies allowed in NYS?
Yes, they’re considered “off-premises delivery”
What must an out-of-state mail-order pharmacy do in order to send meds to NYS residents?
Register as a nonresident establishment
Requirements for out of state pharmacies
Must be licensed/registered with their home state in order to seek registration in NYS
Must provide a toll-free number during normal business hours and at least 40 hours/week for communication between the patient and RPh
Must designate a resident agent in NYS

Exemption to mail-order pharmacy registration requirements
NYS may grant exceptions to registration requirements for nonresident establishments that restricts its sale or dispensing of drugs to residents to “isolated transactions”
What is considered an isolated transaction?
Pharmacies that send <600 Rx/year
<$10K in sales for wholesalers and manufacturers
Significance of isolated transactions
They’re necessary to protect the public health by addressing emergency shortages of drugs/devicess in NYS
Is a license needed for mail-order to other states?
The language in the law is unclear, but I believe you would need a license in that state in order to send stuff over there since you’d be subject to that state’s laws
