What is the definition of going equipped?
Sec 25. (1) Theft Act 1968 & Amended by Fraud Act 2006

- When not at their place of abode
- Has with them
- Any article
- For the use in the course of or in connection with any burglary or theft

What are the penalties?
A
- Either way offence
- 3 years maximum in prison
- for going equipped for theft of a motor vehicle or TWOC there is also the option of a discretionary disqualification

What is a place of abode?
A
This offence s always committed away from where that person lives and sleeps.
It can never be committed at a place of work, unless the person also resides there.

A
What constitutes immediate control of the item in relation to item and the person is for the courts to decide.

A
Many everyday items such as tools, are articles that can be used to force entry to premises.
