What is the definition of Handling Stolen Goods?
A person handles stolen goods if (otherwise then in the course of stealing) knowing or believing them to be stolen goods, he dishonestly receives the goods OR
Dishonestly undertakes or assists in their retention, removal, disposal or realisation by or for the benefit of another person OR
Arranges to do so.
Can handling stolen goods happen without theft?
No
What are goods?
Money and every other description of property, except land and includes things severed from land by stealing.
What are stolen goods?
Any goods obtained by theft, fraud or blackmail. Any other goods that have directly or indirectly represented the stolen goods of anytime in hands of the thief or handler.
What is knowing?
Have been told or has first hand knowledge.
What is believing?
Short of knowledge. Therefore if a person takes possession of stolen goods and does not know or believe- there is no handling.
What is receiving?
Gaining possession, having knowledge that the goods are stolen at the time of receipt.
What is undertaking or assists?
Undertakes has been held to include where the person agrees to perform the act or acts constituting the offence.
What is retention, removal, disposal and realisation?
Retention: Means keeping in ones own possession or control
Removal: Means moving a thing to another place
Disposal: Means the act of disposing or getting rid of or bestowing or giving.
Realisation: Means conversion into cash or money.
