What is the definition of Taking a Conveyance Without Consent (TWOC) under Section 12 (1) Theft Act 1968?

A

A person shall be guilty of an offence if, without the consent of the owner or other lawful authority, he/ she takes any conveyance, for his/ her own or another use.
OR
Knowing that any conveyance has been taken without such authority, drives it or allows themselves to be carried in or on it.

What is a conveyance?

A

Any conveyance constructed or adapted for the carriage of a person or persons by land, water or air. A vehicle made or adapted to carry a person or persons drawn by an animal is also a conveyance.

One constructed or adapted only for use under the control of a person not carried in or on it.

A

Consent must be true consent. Going beyond the express or implied permission of the owner may negate the consent.

A

A person takes if they assume possession or control of a conveyance and move it or cause it to be moved.

A

This relates to a person who was not present at the time of the actual taking.
