What are the penalties under current health and safety legislation
Breach of H&S at work etc act is unlimited fine, up to 2 years in prison or both.
Is it a criminal offence to breach the H&S at Work Act 1974
Yes breach of H&S regulations is a criminal offence. Company or individual can be prosecuted by Health and Safety Executive (HSE) and lead to fine or imprisonment or both

What is the safe person concept?
Each individual assumes individual behavioural responsibility for their own, their colleagues and others’ health and safety whilst at work.
Purpose of H&S is to minimise risk of harm.
What must regulated firms provide?
RICS regulated firms are obliged to ensure the health, safety and welfare of people at work by providing, monitoring and maintaining:
- a safe working environment
- safe work equipment
- safe systems of work
- competent staff
What happened in the case of Suzy Lamplugh?
Suzy was an estate agent who went missing after meeting a potential purchaser of a property called “Mr Kipper”
Why is the case of Suzy Lamplugh important for surveyors?
Highlights the potential risk for anyone working alone and meeting a stranger.
Surveying firms or anyone working in similar circumstances needs to be alert to risk and put in place sensible precautions
What is personal protective equipment? (PPE)
Protective clothing, helmets, goggles, or other garments designed to protect the wearers body from injury or infection.

What is a hazard?
Dangerous phenomenon, substance, human activity or condition that has potential to cause loss of life, injury, property damage, social and economic disruption or environmental damage
How would you undertake a risk assessment before attending site?
Taking adequate time to fully consider how any plan of action could deviate from what you expect.

What is asbestos ?
Naturally occurring rock mineral that has heat and fire resisting properties, it has been used worldwide in building materials and now known to potentially cause respiratory disease
What legislation are you aware of in relation to asbestos?
The Control of Asbestos Regulations 2012
(but also covered in H&S at work etc Act and in the CDM regulations)
What do you understand by the Control of Asbestos Regulations 2012?
Reg 4: duty to manage asbestos in non-domestic premises (all industrial and commercial buildings)
Who is the duty holder? (In relation to Asbestos regulations)
Anyone who has contractual maintenance or repair responsibilities or (if no contract or tenancy) those in control of premises.
