When is a driver considered to be in violation of a DUI
21 years old or older operating a vehicle = 0.08% or higher blood alcohol concentration (BAC).
Operating a commercial vehicle = 0.04% or higher BAC.
Operating a vehicle younger than 21 years old = 0.01 or higher BAC
What are the three phases of DUI?
Vehicle In Motion
Personal Contact
Field Sobriety Test (FST)
What are examples for Vehicle in Motion?
Weaving or erratic driving
Wide or sharp turns
Speed significantly less than posted limit
Speed in excess of posted limit
Sudden stops
What are examples of Personal Contact?
Observations based in what officer sees, hears, smells.
Slurred speech
Red or glossy eyes
Disarrayed clothing
Alcoholic beverage smell
Sleepy or lethargic.
Evaluate driver by asking multiple questions or asking to do things simultaneously.
Ask to demonstrate something simple such as counting backwards, reciting alphabet, etc.
What are the three FSTs
One leg stand.
Walk and turn.
Horizontal Gaze Nystagmus. (HGN)
What is the DD Form used for DUI procedures?
The DD Form 1920, Alcohol Influence Report will be completed while the tests is occurring.
What is article 113, UCMJ?
Drunken or reckless operation of a vehicle, aircraft, or vessel.
