Letter of Deviation (LOD)
- The COTP or OCMI may authorize, upon written application, a deviation from any rule in 33 CFR Part 164
- Issuance of a LOD does not preclude the possibility of pursuing civil penalty action and is not an appropriate control action for Security Deficiencies.
Delay
The COTP/OCMI may delay a vessel’s entry until it corrects certain deficiencies
Restriction of operation of vessel movement
The COTP/OCMI may impose restrictions on vessel operations or movements if vessel deficiencies pose security or safety threats.
Whenever a COTP order is issued to solely comply with U.S. regulations, the authority for the order should be the PWSA.
Custom Hold
Under 46 U.S.C 91, vessels intending to depart the U.S. for foreign port should obtain a clearance from CBP.
If allegations exists that the vessel has violated certain U.S. Safety & Pollution laws, the CG may request that CBP deny or withhold the required clearance until the vessel posts a letter of undertaking or surety bond.
COTP Order
- An important tool used to protect the safety & security of the port
- May use COTP orders to implement a variety of control actions, including control of movement.
- There are potential civil & criminal penalties for violating a COTP order.
Denial of Entry or Expulsion
- Use this option only when allowing a vessel into the U.S. waters or when permitting a vessel to remain in U.S. waters would create an unacceptable level of risk, or immediate threat to the port, personnel or environment.
- COTP may not expel a vessel for safety consideration under SOLAS, use the PWSA.
- COTP may however expel a vessel for security consideration under the authority of SOLAS
IMO Reportable Detentions
An IMO Detention should be the primary course of action when there are clear grounds that a vessel subject to the IMO instruments is substandard & corrective measures are necessary.
Comprehensive Security Inspection
- Minimum control action to take when clear grounds of a security deficiency are established
- Detailed inspection, possibly including a review of relevant portions of the SSP
Administrative Compliance Measures
- Letter of Warning (LOW)
- Notice of Violation (NOV)
- Class 1 Civil penalty
- Class II Civil penalty
- Surety Bond
- Letter of Undertaking (LOU)
Lesser administrative/corrective measures
- Requiring corrective measures within a specific period
- Prior to return to the U.S.

Plimsol mark deficiency Write-up
As you approach a vessel to conduct your PSC exam you notice 2 plimsol marks on the side of the hull. After reviewing the ICLL Ceritificate you double check and the markings on the side of the vessel do not match the certificate.
No change shall be made in structure, equipments, materials, or scant lints without sanction of the Administration. The plimsol markings not the vessel did not match the approved markings indicated by the Administration on the ICLL Certificate. ICLL 9
