Free and Appropriate Public Education

private schools/laws don’t have to give disability services (students in private schools can get tested but funding can’t come through the state)
Originally passed as PL 94-142 in 1975 (Education for All Handicapped Children Act)
these students were prohibited from going to school, they would stay at home or were sent away

Key Part of an IEP is LRE “To the maximum extent appropriate, children with disabilities, including children in public or private institutions or other care facilities, are educated with children who are nondisabled.”
Individualized Education Plan
Schools must provide a continuum of placements for students with disabilities so that the individual needs of each student can be met.

School districts cannot suspend children with disabilities for more than 10 days without it being considered a change of placement. The IEP team must reconvene. An FBA and BIP is required if not
already in place
