Age discrimination in Employment act (1967)
federal act stating it is unlawful for an employer to discriminate against an individual in any aspect of employment because that individual is 40 years or older unless statutory exceptions apply
American disabilities act (ADA) (1990)
federal legislation ensuring equal opportunity for and elimination of discrimination against persons with disabilities
Arbitration
a proceeding in which disputes are submitted to a third party or a panel of experts outside the judicial trial system
Authority
the right to make decisions and take actions necessary to carry out assigned tasks
Behavioral description interview
an interview format that requires applicants to give specific examples of how they have performed a specific procedure or handled a specific problem in. the past
Civil Rights Act, Title VII (1964)
the federal legislation that prohibits discrimination in employment on the basis of race, religion, color, sex, or national origin
Civil Rights Act (1991)
federal legislation that focuses on establishing an employer’s responsibility for justifying hiring practices that seem to adversely affect people because of race, color, religion, sex, or national origin
Compensable factors
a characteristic used to compare the worth of jobs; for example, skills, effort, and working condition
Compromise
method of conflict management where both parties must be willing to lose or give up a piece of their position
Conflict management
a problem-solving technique that focuses on working with individuals to find a mutually acceptable solution
Constructive confrontation
a method of approaching conflict in which both parties meet with an objective third party to explore perceptions and feelings
Control

Exempt employees
specific groups of employees who are identified as not being covered by some or all provisions of the Fair Labor Standards Act
Exit interview
the final meeting an employee has with his or her employer before leaving the organization

a complex quantitative method of job evaluation that combines elements of both the ranking and point methods

Family Medical Leave Act (FMLA)
federal legislation that allows full-time employees time off from work (up to 12 weeks) to care for themselves or family members with assurance of equivalent position upon return

Grievance
a formal, written description of a complaint or written disagreement
Grievance Procedures
the steps employees may follow to seek resolution of disagreements with management on job-related issues
Harassment
the act of bothering or annoying someone repeatedly
Hay method of job evaluation
a modification of the point method of job evaluation that numerically measures the levels of three major compensable factors
Job classification method
A method of evaluation that compares position descriptions of various classifications grades; 2. A method used by federal government to grade jobs
Job evaluation
the process of applying predefined compensable factors to jobs to determine their relative worth
Job ranking
a method of job evaluation that arranges jobs in a hierarchy on the basis of each job’s importance to the organizations
Job specification
a list of job’s required education, skills, knowledge, abilities, personal qualifications, and physical qualifications
Labor-Management Reporting and Disclosure Act (Taft-Hartley Act)
Federal legislation that imposed certain restrictions on unions while upholding their right to organize and bargain collectively
Labor relations
human resources management activities associated with unions and collective bargaining
Layoffs
unpaid leaves of absence initiated by the employer as a strategy for downsizing staff in response to a change in the organization’s status
Mediation
when an objective third party unrelated to the dispute is invited to bring the parties to a mutual agreement

a legislation providing union representation and prohibits unfair labor practices by unions
Nonexempt employees
all groups of employees covered by the provisions of the Fair Labor Standard Act

Orientation
a set of activities designed to familiarize new employees with their jobs, the organization, and the work culture
Panel interview
an interview format in which the applicant is interviewed by several interviewers all at once
Performance review
an evaluation of an employer’s job performance
Performance standards
the stated expectations for acceptable quality and productivity associated with a job function
Point method
a method of evaluation that places weights (points) on each compensable factor in a job whereby the total points associated with a job establish its relative worth and jobs that fall within a specific range of points fall into a pay grade with an associated wage
Policy
statement about what an organization or department does
Position (job) description
a detailed list of a job’s duties, reporting relationships, working conditions, and responsibilities
Pregnancy Discrimination Act (1978)
federal legislation that prohibits discrimination against women affected by pregnancy, childbirth or related conditions
Procedure
a document that describes the steps involved in performing a function
Progressive Discipline
a four-step process for shaping employee behavior to conform to the requirements of the employee’s job position that; it begins with verbal caution and progresses to written reprimand, suspension, and dismissal
Recruitment
the process of finding, soliciting, and attracting employees
Reference check
contact to the individual(s) the prospect employee listed to provide positive attributes
Reliability
the consistency with which a test measures an attribute
Responsibility
the accountability required as part of a job, such a supervising work performed by others or managing assets or funds
Retention
the ability to keep valuable employees from seeking employment somewhere else
Structured interview
an interview format that uses a set of standardized questions that are asked for all applicants
