What is a tort?
civil wrongful acts or omissions made against a person or property
What are the 3 types of intentional torts?
- assault
- battery
- false imprisonment
What is the difference between assault and battery?
– assault: fear of harmful, imminent, or unwelcome contact
- can be a threat – no contact has to actually occur
– battery: intentional offensive touching without consent or legal justification
What is a quasi-intentional tort? What are the 3 types?
– quasi-intentional tort: acts which a person may not intend to cause harm to another but does
– 3 types:
- defamation of character
- slander
- libel
What is the difference between defamation of character, slander, and libel?
– defamation of character: publication of false statements that damage reputation
– slander: speaking falsely about another
– libel: written defamation of character
What are unintentional torts? What are the 2 types?
– unintentional torts: arise when a person is harmed and the person inflicting harm knew or should have known
– 2 types:
- negligence
- malpractice
What is the difference between negligence and malpractice?
– negligence: conduct that falls below the generally accepted standard of care of a reasonably prudent person
– malpractice: type of negligence
