3 questions that CJ system aims to solve
What conduct is criminal? What determines guilt? What should be done with the guilty?
4 goals of punishment
Retribution, deterrence, incapacitation, rehabilitation
Retribution
Punishment inflicted on someone who harmed other ppl and deserves to be penalized
Deterrence
Discouraging an action or event through instilling fear of the consequences or doubt
Incapacitation
Depriving lawbreaker of ability to commit crimes against society usually done w prison
Selective incapacitation
Making the best use of expensive and limited prison space by targeting to imprison ppl whose incapacitation will do the most to reduce crime in society
Rehabilitation
Goal of restoring a lawbreaker to a constructive place in society through vocational or educational training or therapy
Restorative justice
Punishment designed to repair damage done to victim/community by offender; victim plays active role (possible 5th goal of punishment)
Presentence report
Report prepared by a probation officer presenting convicted offender’s background and is used by judge in selecting
Sentencing guideline
Mechanism to indicate to judges the expected sanction for certain offenses to reduce disparities in sentencing
