What is a Juvenile Non Offender ?
Any juvenile who committed an offense for which adults cannot be charged.
What is a Juvenile Delinquent Offender ?
Charged with an offense that an adult could be charged.
What is Payton V. New York ?
Requires officers having probable cause to make an arrest to obtain a warrant. If time permits.
What should an officer do in the event he arrests military personnel ?
Contact that branch of the military and give defendant’s name, SS#, and assigned unit.
Arrests of illegal aliens -
Contact ICE to determine immigration status and document in arrest report . If illegal, forward the info to intel unit.
What should an officer do in the event an SPO detains someone for a misdemeanor or felony ?
Officer shall evaluate the circumstances, obtain written statements and write incident report. If an arrest is not made, a supervisor must agree.
Strip squat searches -
Requires the approval of the SGT or above. Must be conducted in a private area within the departmental facility. Conducted and witnessed by officers of the same sex as the arrestee.
Strip squat search in exigent circumstances-
If the safety of officers or others is threatened, a strip/squat may be conducted before transport. Before the search, officers must get approval from a commissioned officer. Complete incident report and CIR. supervisor who approves, will sign the 88s.
When a temporary detention cell or interview room is used at a PGPD facility that is not DOC operated, how long can an arrestee be held without continuous supervision by personnel ?
Shall not exceed 2 hours
If the arrestee is held for more than 8 hours, what should the officer provide ?
Bedding and meals
If the arrestee is secured in a cell, interview room or any other locked space. How how often should the custody officer observe or check on the arrestee ?
At least once every 30 minutes and document it. CCTV to be used in between checks.
When conducting an inventory or an arrestee’s money or valuables. Who should sign the prisoner property form ?
A witness
How long can a juvenile be held or detained ?
6 hours. Meal provided if necessary. 3 per 24 hour period. No longer than 14 elapsing between each.
How long does an officer have to schedule a felony screening appointment ?
72 hours. Appt made within 14 days.
Mass arrest situations -
Before the arrestee is transported, the transport officer shall photograph the arresting officer with the arrestee. Picture shall be attached to incident report. Officers ID number and name of arrestee on the back. If arrested for felony, arrestee should be transported in a separate vehicle.
