What is the PBT used for ?
Used to develop additional probable cause to detain and additional. The defendant does not have the right to speak with an attorney before deciding whether to submit to a PBT. The results may not be used as evidence, but the results should be included in the reasonable grounds section of the DR 15A.
How long do you have to take breathe or blood specimen ?
Within 2 hours following the time the arrestee was apprehended. Must observe the defendant for 20 minutes before the test to ensure that they do not ingest or smoke any substances before the test.
Following the blood test, what should be done with the specimen ?
Immediately after the blood is collected, mix the blood with the anticoagulant powder by slowly and completely inverting the test tube five times. DO NOT SHAKE.
While submitting blood tests, what should an officer include on the form ?
Signature
SSN of person withdrawing blood.
Hospital address.
What is the BAC of licensees less that 21 years old ?
Prohibited from having a BAC of .02 or greater. Licensees with designated alcohol restriction are prohibited from having any alcohol in their blood.
Driving Under Influence Of Drugs
Officer shall not confiscate an arrestee’s driver’s license for driving under under the influence of drugs, unless the officer is a Certified Drug Recognition Expert.
Case disposition
Arresting officer shall note the court disposition of the case in the State of MD Alcohol Program Testing Log within 72 hours of adjudication.
