Arrest Warrants

Question 1

The Justice must be given RG to believe that it is in the PUBLIC INTEREST that a warrant must be issued. PUBLIC INTEREST may include:

1. has FLED
2. is EVADING CAPTURE
3. DANGER to the PUBLIC
4. DANGER to VIC and/ WIT
5. NATURE and/ SERIOUSNESS of the offence
6. All ATTEMPTS to LOCATE exhausted

Question 2

When executing an arrest warrant SHALL

1. NOTIFY OPERATIONS SUPERVISOR - Communication Services
2. Ensure proper announcement is made prior to entry , except:
   - as provided on the warrant
   • where there are RG to believe that prior announcement of the entry would
     - expose officer / othe
     Person to imminent
     Bodily harm/death
     - result in the
     Imminent loss/ dest
     Of evidence relating
     To the commission
     Of an Indictable
     Offence

Question 3

When seizing property during the execution of an ARREST WARRANT SHALL

Answer 3

FILE the applicable S/W return WITHIN 7 days of the EXECUTION at the COURT location indicated in the NOTICE TO OCCUPANT section

When processing a person on a BW, in addition to (pg44) SHALL enter the following

1. Original CHARGE and TYPE of RELEASE
2. ORIGINAL ARREST DATE
3. ORIGINAL court date and location
4. Name of JUSTICE who Issued WARRANT
5. REASON for NOT attending COURT

Question 5

When processing a person on a MATERIAL WITNESS warrant, in addition to (pg44) SHALL

Answer 5

1. SYNOPSIS
2. SHOW CAUSE, including the NEXT scheduled APPEARANCE DATE for the CASE in which the person is WANTED AS A WITNESS
3. INSERT all DOCUMENTS in the ORIGINAL CROWN ENVELOPE fir the CASE the person is WANTED as a WITNESS and submit to the OIC
4. DO NOY fingerprint if soley arrested for a material witness warrant

Question 6

When a person is brought into custody on an ARREST WARRANT SHALL

Answer 6

1. Ensure the individual is the person named/described in the warrant
2. Ensure RMS-Ops in notified to REMOVE warrant from CPIC
3. Ensure compliance with applicable procedures
4. Where a warrant is endorsed for release, consider releasing the arrested person in compliance with applicable procedures
5. If the person is transported to a CENTRAL LOCK UP, that the CROWN ENVELOPE, copies of the eREPORT, PRISONER TRANSPORTATION LIST and INFORMATION pertaining to the new charge accompanies the person.
