Now I shall prove to you by a great and clear piece of evidence that Phrastor would not have done this if he had not been ill.
ὡς⌈ γὰρ ἀνέστη ⌉τάχιστα ἐξ ἐκείνης τῆς ἀσθενείας ὁ Φράστωρ, λαμβάνει γυναῖκα ἀστὴν κατὰ τοὺς νόμους, Σατύρου μὲν τοῦ Μελιτέως θυγατέρα γνησίαν, Διφίλου δὲ ἀδελφήν·
For as soon as Phrastor recovered from that illness, he took a citizen wife according to the laws, the legitimate daughter of Satyros of the deme of Melite, the sister of Diphilos.
ὃ ὑμῖν ἐστι τεκμήριον, ὅτι οὐχ ἑκὼν ἀνέλαβε τὸ παιδίον, ἀλλὰ βιασθεὶς διὰ τὸ⁀νοσεῖν καὶ τὸ⁀ἄπαις⁀εἶναι καὶ τὸ⁀θεραπεύειν αὐτὰς αὑτὸν καὶ τὸ⌈ τοὺς οἰκείους ⌉μισεῖν.
This is proof for you that he did not willingly take back the child, but was forced to do it because of his sickness and the fact that he was childless and because the women were looking after him and because he hated his relations.
εἰ γὰρ μὴ ἠσθένησε Φράστωρ, οὐκ ἂν ἀνέλαβε τὸ παιδίον.
For if Phrastor had not been ill, he would not have taken back the child.
καὶ δὴ καὶ ἄλλο τεκμήριον βούλομαι ὑμῖν ἐπιδεῖξαι ὅτι ξένη ἐστὶ Νέαιρα αὑτηί.
And furthermore, I want to show you another proof that this Neaira is an alien.
ὁ γὰρ Φράστωρ, ἐν τῇ ἀσθενείᾳ ὤν, εἰσήγαγε τὸν Φανοῦς παῖδα εἰς τοὺς φράτερας καὶ τοὺς Βρυτίδας, ὧν Φράστωρ ἐστί γεννήτης.
For Phrastor, when he was ill, introduced Phano’s son into the phratries and into the Brytidae, of whom Phrastor is a member.
ἀλλὰ οἱ γεννήται, εἰδότες τὴν γυναῖκα θυγατέρα Νεαίρας οὖσαν, …
But the members of the clan, knowing that his wife was the daughter of Neaira, …
καὶ [οἱ γεννήται] ἀκούσαντες Φράστορα αὐτὴν ἀποπέμψαντα, ἔπειτα διὰ τὸ⁀ἀσθενεῖν ἀναλαβεῖν τὸ παιδίον, …
and [the members of the clan] having heard that Phrastor had divorced her and had then because of his illness taken back the child, …
(οἱ γεννήται) ἀποψηφίζονται τοῦ παιδὸς καὶ οὐκ ἐνέγραφον αὐτὸν εἰς τὸ γένος.
[the members of the clan] voted against the child and did not register him in the clan.
ἀλλ’ εἰ ἀστῆς θυγάτηρ ἦν Φανώ, οὐκ ἂν ἀπεψηφίσαντο τοῦ παιδὸς οἱ γεννῆται, ἀλλ’ ἐνέγραψαν ἂν εἰς τὸ γένος.
But if Phano had been the daughter of a citizen, the members of the clan would not have voted against the child, but would have registered him in the clan.
λαχόντος οὖν τοῦ Φράστορος αὐτοῖς δίκην, …
Therefore when Phrastor brought a suit against them,

προκαλοῦνται αὐτὸν οἱ γεννῆται ὀμόσαι καθ’ ἱερῶν τελείων ἦ⁀μὴν νομίζειν τὸν παῖδα εἶναι αὑτοῦ υἱὸν ἐξ ἀστῆς γυναικὸς καὶ ἐγγυητῆς κατὰ τὸν νόμον.
the members of the clan challenged him to swear by the sacred mysteries that he truly believed the child to be his own son from a citizen wife legally married in accordance with the law.
προκαλουμένων δ’ αὐτὸν τῶν γεννητῶν, ἔλιπεν ὁ Φράστωρ τὸν ὅρκον καὶ ἀπῆλθε πρὶν ὀμόσαι τὸν παῖδα γνήσιον εἶναι.
When the members of the clan challenged him, Phrastor abandoned the oath and went away before he could swear that his son was legitimate.
ἀλλ’ εἰ ὁ παῖς γνήσιος ἦν καὶ ἐξ ἀστῆς γυναικός, ὤμοσεν ἄν.
But if his son had been legitimate and born from a citizen wife, he would have sworn.
