What is the Witness K case
The Witness K case revolves around the revelation that the Australian Government had bugged the Timor-Leste cabinet room during sensitive negotiations about oil and gas revenue. Witness K with the approval of ASIS was allowed to seek legal advice. Upon seeking legal advice, the lawyers said the state was in the wrong and he was allowed to build a case as the actions against Timor Leste was wrongful
When did Witness K get prosecuted
In 2018, the Commonwealth Director of Public Prosecutions initiated prosecutions against Witness K and Bernard Collaery for their role in revealing the bugging of the Timor-Leste cabinet room during sensitive negotiations about oil and gas revenue
Why does the case not uphold open trials to deliver public confidence
The case was held in secrey therefore it did not uphold natural justice as it uphold the trial to deliver public confidence. This undermines natural justice.
There was no hearing both parties
As Bernard Collary was arrested and was not allowed to represent his client Witness K. His house has raided and the notes for against which Bernard Collary built up was stolen
