delegated legislation Flashcards
1
Q
definition
A
Law making power granted by the parliament to the executive. Executive made laws are called regulations, ordinances or instruments. To avoid a breach of the separation of powers the parliament closely monitors the executive’s use of delegated legislative power. The Senate Standing Committee for the Scrutiny of Delegated Legislation oversees regulations, ordinances and instruments. The Senate may pass ‘disallowance motions’ which annuls that law or a part of the law.
