What is Federalism
Federalism is the division of a nation’s sovereignty between one nation and two or more regional governments
The three types of relationships between the two forms of government
Coercive Federalism
Dual/coordinate/cooperative federalism
Confederation
What is coercive federalisim
The national government is more powerful than the regional government
What is dual/coordinate/ cooperative federalism
both levels have about the same amount of power
What is confederation
Regional government have more power than national government
How can the power relationships between the two governments change
- High Court decisions about the meaning of the constitution
- Referendums to change constitution can alter federal balance of power
- Referral of powers
What is exclusive division of powers?
Powers granted to the Commonwealth Parliament by the Constitution and can only be legislated on by the Commonwealth
- s.52 - Commonwealth Parliament has exclusive power to make laws for the peace, order and good government of the Commonwealth with respect to the seat of the Commonwealth and the Commonwealth public service
- s.90 - Commonwealth to collect customs, excise and duties
- s.114 - states may not raise armed forces
- s.115 - a state shall not coin money
What is concurrent division of powers?
Power granted by the Constitution to the Commonwealth and state parliaments = shared powers
What is residual division of powers?
All government powers not specified / enumerated in the Constitution – these are exercised by the states
- Residual powers relate to matters that are regional in nature, e.g.
- Education
- Health
- Roads and railways
- Criminal and civil law
What is unitary system of government?
Unitary system of government is when the the sovereignty of nation is undivided
