U8 Section 4-crime And Punishment Flashcards
What is crime?
An act against the law.
What is the law?
Rules made by Parliament and enforceable by the courts.
Why do we need laws and justice?
We need laws so that people know what sort of behaviour to expect from each other.
If there were no rules there would be chaos.
Why may some people still argue that we don’t need laws?
Laws restrict human freedom and individuals should be free to do as they wish.
What is justice?
Due allocation of reward and punishment/the maintenance of what is right.
Give two reasons why there needs to be a connection between law and justice.
If a law is unjust, people will feel that it is right to break the law and will campaign against law, causing trouble in society.
If some laws are unjust, then they are not fulfilling the purpose of making sure that people are rewarded for their work, the weak are protected etc
Name the four theories of punishment.
Deterrence, retribution, protection, reform
Name one problem for each Theory.
Deterrence=punishments have to be very severe.
Retribution=It makes you as bad as the criminal because you are doing the same thing.
Protection=offender may not change when released
.
Reform= Offenders may pretend to be reformed
