What is a tribunal
Where private disputes between 2 people are solved in a particular area of law
What are the advantages of tribunals
- More specialised than court
- Fair and equal process
- Cheaper alternative to court
- Faster hearings
What are the disadvantages of tribunals
- Hearings may be delayed due to the amount of cases
- Complicated cases may have to be transferred to court
- Less formal than courts
- Not trained lawyers
- Public funding not available
What are administrative tribunals and give examples
Solves disputes between individuals and government agencies e.g. rent, employment and immigration tribunals
What is negotiation
A form of ADR where there is no third party as the two parties try to reach a compromise by negotiating
What is arbitration
A third party know as an arbitrator who plays a similar role to a judge as they hear both parties and provide a solution which is a legally binding decision.
What is mediation
Where a mediator tries to reach a compromise between the two parties which is ot legally binding
What is conciliation
Where a conciliator comes up with a suggestion to how the problem between both parties can be solved
