Define “Towage”…
An agreement between ship owner and towage company to offer pull, push or escort services
Define “Salvage”…
A voluntary service to a ship , to save them due to the fact they are in peril & danger
What is LOF? and how can it be agreed?
Provides a regime for determining the amount of remuneration to be awarded to salvors for their services. NO CURE NO PAY.
Can be agreed physically with a signed document however via radio is suitable
What is the SCOPIC Clause?
SCOPIC clause sets, by tariffs, the amount of remunerations to the salvor based on the efforts provided. Equipment, expenses and expertise provided. NO/SOME CURE SOME PAY.
Will provide less remunerations if cure is provided so if salvors want to invoke the SCOPIC clause, the situation is bad.
What is General Average?
General Average is a long-established principle of Maritime Law which requires contribution from all whose goods were saved to the losses of those whose goods were sacrificed at time of common peril
Requires:
- Extraordinary Sacrifice
- Intentional
- For Common Safety
- Peril Present
Who contributes to General Average?
- Ship Owner
- Cargo Owners/Voyage Charterer
Preparations for towing operations?
- Risk assesment
- Consult Emergency Towing Booklet
- Asses bollard pull of the tug and SWL of bitts
- Weather conditions
- Communication plan
- Fatigue, experience, hazards
- Stability
What is the Safe Towing Load?
The maximum load allowed exerted on the ships fittings for the purpose of towing operations at sea.
SWL of fittings should be references for mooring operations in harbours or similar sheltered waters.
