Define Small Claims Procedure
If a consumer cannot resolve a complaint with a business, they can take the case to the small claims court.
Claims up to €2,000 may be made on
- Faulty goods
- Poor-quality production
- Damage to property
It is cheap, easy, and fast, without the need for a solicitor
Small Claims Procedure
Application - Submit an application form outlining complaint and amount claiming for. Is sent with a small fee.
Small Claims Registrar - The Small Claims Registrar organises a meeting with the consumer and business to resolve the dispute. If it cant be resolved, it is referred to the district court.
Referral to the District Court - Listens to all witnesses, then makes a decision on the case. They can then award amount claimed, order goods be repaired, or award financial compensation.
Appealing a Decision - If the consumer or business is not happy with the decision, they can appeal to the Circuit Court within 14 days.
