What are DS responsibilities for incidents involving firearms?
forward a copy of 1.1 to the commander of the licensing unit,
likewise if you have seized a FID or LTC
Do starting pistols and airsoft guns count as firearms for evidence?
yes for the rule as to how to handle them
What happens to department issued firearm or personal firearm that was discharged?
Firearms analysis examiner unit holds
If a person or property was struck, FTE retains as long as necessary to complete investigation. PCom can only authorize return of firearm (in writing)
What is process for unclaimed firearms>
held for one year (if no prosecution)
letter sent by certified mail
30 days to respond
How long is ammunition stored pursuant to an RO?
as long as it is safe to do so. anything beyond the storage capability of FAEU shall be desroyed
What happens to a firearm that a person wants to reclaim ?
They need a court order to return the firearm
What is the process for a citizen to get a firearm back?
in writing to the commander
Captain submits report to BFS chief including recommendations
Chief forward to licensing commander
To legal advisor
To PC
How long does a firearms return request have to be processed?
30 days
If someone is shot and bullet fragment recovered, where is this evidence stored?
FAEU
Can the FAEU be called out?
yes, where a delay in rendering the desired services would hamper the investigation
