A

1) There is no less drastic means available to defend oneself or another from an attack or imminent attack which an officer has reasonable cause to believe could result in death or great bodily injury

2) There is no less drastic means available to apprehend a fleeing suspect when the officer has probable cause to believe that: 1) the suspect has committed a felony during the commission of which they inflicted or threatened to inflict deadly force upon the victim or 2) that there is a substantial risk that the suspect in questions will cause death or great bodily injury if their apprehension is delayed

3) There is no less drastic means available to kill a dangerous animal or one so badly injured that humanity requires its removal from further suffering

A
  • suspect is armed with a deadly weapon and is actively posing a lethal threat
  • distance necessary to engage an armed suspect is beyond the effective range of an officer’s service pistol
  • suspect is protected by materials that may not be penetrated by the officer’s service pistol, or suspect may be wearing body armor
  • officer is faced with one or more heavily armed suspects or suspects utilizing sophisticated weaponry
  • Officer is faced with a dangerous animal that needs to be neutralized to ensure safety of bystanders and the officer
