When reviewing each fleeing driver event what 5 things will be considered
- Was it lawful
- Was it justified considering all of the circumstances
- Was it appropriate
- Was it compliant with Police instructions
- What lessons are to be learnt and applied
What are the 10 overall principles of fleeing driver
- Safety of the of all takes precedence over the apprehension of driver
- Failing to stop or remain stopped is not a sufficient reason to commence a pursuit
- An investigation is preferred over the commencement of a pursuit
- It is only justified when the threat posed by the vehicle outweighs the risk of harm created by the pursuit
- Police will consider the likely impact of any response particularly when there is youth or children involved
- All staff are responsible for ensuring the pursuit is managed as safely as possible
- A decision not to pursue will be supported
- All fleeing drivers will be investigated to identify offender
- Events will be reviewed in a timely manner to identify and effectively manage health and safety risks training issues systemic issues or lessons learnt
- Staff maybe criminally liable if their manner of driving contravenes legislation
What TENR things must you consider before signalling a driver to stop
- The initial threat posed by occupants
- The necessity to immediately apprehend the driver
- The risk of harm to any person
As a field supervisor what is your responsibilities when overseeing a pursuit
- Maintain supervisory oversight
- Provide support to staff and pursuit controller avoiding direct involvement in the pursuit where possible
- Continuously perform own TENR to assess whether pursuit continued to be justified
- Direct abandonment if their TENR assessment identifies the risk of harm outweighs the initial threat
