Revocation Flashcards
Revocation and technical violation
We no longer revoke for first technical parole violation (drug use, missed visit, other non-compliance)- now we have graduated sanctions. N.J.A.C. 10A:72-2:
If thy get arrested for new crime
If it’s super serious, then we’ll attempt to accelerate the revocation process,(accelerated revocation) and have the locals testify. If it’s not too serious, then we’ll likely put em on EM or something like that until the court case is concluded. If it’s for drugs we don’t usually do EM.
Now if the arrest is new it doesn’t automatically mean a parole revocation because that can only automatically happen if there’s a “technical violation” of parole. I.e. drugs, guns then we can immediately do a parole warrant.
Booking process
Review violations with sergeant, sergeant decides. Take em to county jail(whether from office or house), take property off person, and hand the property, body and warrant to jail folks
Revocation hearing tips
Try and say the the good the parolee has done, if there’s any. This way you’ll look more impartial
Ask the officer if one is testifying. “Do you see the person you arrested in this room or on video” depending on if it’s in person or on conference. If it’s on the phone, have a DOC pic and ask about that
Be super specific
