Searches training final word
You can only search the parolees person, residence, or vehicle provided there is a reasonable articulable suspicion that the search will yield evidence if a parole violation. You’ll need the sergeants permission and to be able to explain your suspicion reasoning in order to do anything other than the basic weapons pat down. Usually you’ll be at the parolees house and call the sergeant to get the permission
We can’t do strip or body cavity searches
Remember, police need “probable cause” to conduct a search of a private citizen. Parolees have a reduced expectation of privacy so we only need “reasonable suspicion”
The search should be limited to contraband that they can’t have under their parole conditions
In order to search a 3rd party or an area exclusively under their control, they need to fill out the consent form which I carry on me
Going to another’s home to look for parolee
Can’t unless there’s objectively reasonable basis to conclude that the parolee named in the parole warrant resides in and is currently at be home; parole officer also will need written voluntary consent from resident too (consent form)
