Members have the ability to view all media when writing reports, preparing for court and prior to making voluntary statements
Viewing of media shall be documented on all reports
Members who are subject of an administrative discipline investigation maybe required to give a statement prior to reviewing media
Members shall not playback media for the public

303.5 Public Records Request
Media files may be released to the media under the following circumstances:
- Members responding to Public records request are authorized to view
2 with permission of the sheriff
3 prior to release of media member who recorded as well as member recognized on recording will be notified

Policy 310
Shooting incidents
OIS include Hit and non hit Shootings
Firearms discharge-when deputy discharges firearm without intent to shoot a person. Firearms dish charge include:
Warning shots, animal shooting, unintentional discharge and shooting.
A firearms discharge requires an administrative review.
The handling supervisor and Department Commander will triage the incident and determine the appropriate recourse. This could include a response by the Administrative Response Team (ART) or documentation by handling supervisor forward up the chain of command.

Mandatory Administrative Leave
Any member involved in a traumatic critical incident will be required to take 3 days off with pay.
During this time the member will attend a counseling session with a psychiatric counselor-results are confidential
The department commander will contact the Counseling Team International (TCTI) to arrange counseling sessions.

Administrative Response Team (ART)
Internal affairs personnel dispatched to the scene of an officer involved shooting to collect facts relating to administrative concerns.
The internal affairs admin sgt will enter initial notification into CRM Database
Who investigates OIS HIT shootings for the Sheriff’s Department?

The District Attorney’s Office serves as the Uninvolved Agency for all OIS HIT shootings by department members.
The DA will review all OIS non-hit shootings and determine if there is criminal culpability.

Who investigates OIS outside of Orange County?
The agency whose jurisdiction the incident occurred in.
If geographically practical the Criminal Investigation Bureau will respond and conduct a a parallel investigation.
The ART Team will also respond
What does the administrative review of a OIS or firearms discharge include?
- An administrative review will be completed by the ART team in compliance with policy 300
- The Supervisory Use of Force Analysis required by Policy 300 will be superseded for OIS incidents by an Internal affairs investigation.
- All officer involved shootings will be subject to of a Critical Incident Review (CIR) per policy 301
- An Internal Affairs investigation will be conducted into all shooting incidents. The I/A investigation will be rolled to await the DA’s review and conclusion into criminal culpability. The Sheriff may direct I/A investigation to proceed immediately if circumstances warrant it. This would include an order to compel statements from involved members.
- All discharge incidents will be administratively reviewed by the involved members division commander and may be forwarded for further action l if circumstances warrant
Duties of Department Commander upon learning of an OIS?
The department commander shall be responsible for the coordinating of resources and making the appropriate notifications.

What is Criminal Investigations Bureau (CIB Lt/Sgt) roll?
CIB will be responsible for managing the scene and coordinating efforts with the incident commander.
CIB will notify the DA’s “Roll our team” and arrange the services of the coroner and crime lab personnel.
CIB will evaluate the circumstances and coordinate activities that will ensue (warrants, interviews, apprehend suspects).
CIB will conduct a parallel investigation with the DA on all OIS incidents and may be responsible for investigating any underlying criminal acts by non-Department members (suspects).

What is the Incident Commander’s responsibility’s when arriving on scene of an OIS?
- The integrity of the shooting scene, security and crime scene perimeter and associated locations.

- Receipt of informational updates and regular communication with the department commander and public affairs personnel.
- Compliance of on-scene personnel with applicable policies, laws and POBR protocols.
- The identification of deputies involved in an OIS may only be released to the media with consent of deputies or upon formal request filed and processed in accordance with the Public Records ACT.

What is the role of the initial On Scene Supervisor at an OIS?
- Take all reasonable steps to obtain emergency medical attention for all apparently injured individuals.
- Attempt to obtain a Brief overview of the situation from any NON-SHOOTERS.
- If no Non shooters-the supervisor should attempt to obtain a brief voluntary overview from one shooter.
The supervisor shall administratively order any deputy to provide a public safety information necessary to secure the scene and pursue suspects. Public safety information shall be limited to such things as outstanding suspects, involved and outstanding weapons, number and direction of shots fired, parameters of incident scene, identity of know witnesses and similar information.

What is the Public Safety Statement questions?
- Were you involved in a shooting?
- How many rounds did you fire and what direction?
- Do you know if any other deputies fired rounds?
- Did the suspect fire rounds? From where?
- Was anyone injured?
- Any witnesses, where are they?
- Where were you when you fired rounds?
- Outstanding suspects?
- Any weapons or evidence need protected.
Due to the need to take immediate action the shooter deputy is NOT entitled to await representation before answering.
Deputies should be ordered not to discuss the incident with anyone including other supervisors prior to the arrival of assigned criminal investigators and AOCDS.

What should supervisors bear in mind at the scene of an OIS?
- Absent a voluntary statement, the initial on scene supervisor should not attempt to order any deputy to provide information other than public safety information.
- Conduct a public safety sweep for injured parties and damage property.
- Consider the number of suspects, witnesses and deputies to be interviewed as a means of determining the amount of investigation resources needed
- Provide all available information to the Incident Commander, Department Commander, Emergency Operations Bureau. Sensitive info should be provided over secure networks.
Supervisors shall take command of and secure the incident scene with additional personnel until relieved by a investigations Sgt or higher ranking assigned personnel

Supervisor’s role pertaining to shooter deputies after safety statements? We
Shooter deputies should be removed from the scene and away from media attention and outside influences ASAP
The deputy should be placed with a supportive peer or supervisor for reassurance and emotional support. However they shall not discuss the facts or details of the shooting with the member.
Shooter deputies should be transported separately to the station or designated location for further direction.
- Each involved deputy should be given an administrative order not to discuss the incident with other involved deputies
- When a deputies weapon is taken or left at the scene, the deputy will be provided with a comparable replacement weapon.
Art team OIS post scene duties and ready
ART Team will provide a briefing of administrative issues to the Sheriff’s Executive command within 3 days of the shooting.
Admin issues include police related issues, risk management/liability, training concerns, force and force options, tactics, supervisory involvement and control, equipment issues and other factors.
ART will rely on info gathered at the scene from CIB.
Sheriff’s Executive Command will review and Evaluate the issuers and take necessary action
